Terms & Conditions
These Foam Party Terms & Conditions apply to Foam Party services provided by Norivan Kids Entertainment (“Norivan”) and apply in addition to the Norivan Kids Entertainment General Terms & Conditions.
By confirming a Foam Party booking with Norivan, the Client acknowledges that they have read, understood, and accepted these Foam Party Terms & Conditions and the Norivan Kids Entertainment General Terms & Conditions.
1. Site Requirements, Water, Power & Access
Water Access: The Client must provide a standard water faucet within 20 metres of the setup area.
Power Access: The Client must provide a stable 230V power outlet within 20 metres of the setup area.
Water & Power Failure: Norivan is not responsible for failures caused by lack of water access, low water pressure, venue plumbing issues, power cuts, tripped breakers, overloaded circuits, or unstable electricity supply.
Access: The Client must provide clear access to the setup area before Norivan’s arrival.
Setup Area: The Client must provide a safe and suitable outdoor area for the foam machine, sound system, cables, hoses, and activity space.
Setup Failure: If Norivan arrives and cannot set up due to lack of water, lack of power, restricted access, unsuitable surface, or an unsafe setup area, the Client remains responsible for the full cost of the event.
2. Surface & Foam Zone Safety
Recommended Surface: Grass is the recommended surface for Foam Party activities.
Hard Surfaces: If the Client requests or insists on setup on hard surfaces, including tiles, concrete, stone, terraces, or similar surfaces, the Client accepts that these areas may become slippery when wet or covered with foam.
Slipping Risk: Foam play involves water, movement, and slippery conditions. The Client is responsible for ensuring that participants behave safely and that the foam area is suitable for the activity.
Foam Zone: The foam area must be kept clear of furniture, glassware, sharp objects, stones, toys, cables, food, drinks, and any other hazards.
Pools & Water Areas: Foam must not be directed into pools, ponds, water features, or areas where it may create additional safety or cleaning issues.
Footwear & Clothing: Swimwear or suitable clothes for wet play are recommended. Participants should remove shoes before entering the foam area unless otherwise advised for safety.
3. Public Spaces, Permits & Venue Permissions
Public Areas: Norivan does not usually provide Foam Party services in public areas, including parks, beaches, plazas, streets, or other open public spaces, due to safety, access, insurance, water use, drainage, equipment, and local regulation considerations.
Public Space Requests: A permit from the local Ayuntamiento may only authorise the event itself and does not automatically include permission to bring or set up foam machines, hoses, cables, sound equipment, water-based equipment, foam solution, or the required foam activity area in that public space.
Client Responsibility: The Client is responsible for ensuring that any permit, venue permission, public space authorisation, or event approval specifically allows all service elements required for the booking, including foam, water use, drainage, music, equipment, and the full activity setup.
Service Requirements: Norivan can only provide the service if the permitted setup matches the requirements of the selected service and can be carried out safely and appropriately.
Liability for Fines: Any fines, penalties, event stoppages, legal consequences, or cancellation caused by missing permits, incomplete permissions, venue restrictions, public space restrictions, unauthorised water or foam usage, or lack of official authorisation are the full responsibility of the Client.
No Refund for Missing Permissions: If authorities or venue management stop the event due to missing permissions, incomplete permissions, restricted setup approval, or missing documentation, no refund will be issued.
4. Supervision & Safe Use
Role of Norivan Staff: Norivan staff operate the foam equipment and manage the foam activity. Norivan staff are entertainers and equipment operators, not childcare providers or babysitters.
Adult Presence: Parents, guardians, or responsible adults must remain present and available throughout the event.
Children Under 3: Children under 3 years old must be accompanied by a parent or responsible adult inside or near the foam area.
Mixed Ages: If children of very different ages are attending, the Client is responsible for ensuring appropriate adult support so that younger children and older children can participate safely.
Right to Pause or Stop: Norivan reserves the right to pause or stop the foam activity if unsafe behaviour, excessive rough play, alcohol misuse, illegal substances, guest conduct, venue conditions, or safety concerns create a risk.
5. Foam Zone Rules
General Rules: The following rules must be followed at all times:
No glassware
No food or drinks inside the foam area
No sharp objects
No hard toys
No running into equipment
No pushing, wrestling, or rough play
No diving into the foam
No throwing foam at faces intentionally
No interference with the foam machine, hoses, cables, speakers, or equipment
No pets inside the foam area
Unsafe Behaviour: Norivan has zero tolerance for unsafe behaviour, excessive alcohol consumption, illegal substances, or any conduct that puts guests, staff, or equipment at risk.
Right to Terminate: Norivan reserves the right to stop the service immediately without refund if safety is compromised.
6. Foam Solution, Health & Allergies
Foam Solution: Norivan uses professional foam solution designed for event use.
Product Characteristics: The foam solution is biodegradable and suitable for foam party activities.
Skin & Eye Sensitivity: Although the foam is designed for event use, individual skin, eye, or respiratory sensitivity may occur.
Known Conditions: Participants with known skin sensitivities, allergies, eye conditions, asthma, respiratory issues, or other relevant medical conditions should take extra care or avoid participating.
Goggles: Goggles may provide additional comfort, especially for younger children or participants with sensitive eyes.
Client Responsibility: The Client is responsible for informing parents, guardians, and participants about the use of foam before the activity begins.
Allergic Reactions: Norivan is not responsible for allergic reactions, skin sensitivity, eye irritation, respiratory discomfort, or similar reactions unless caused directly by proven negligence by Norivan.
7. Weather & Technical Safety
Unsafe Weather: Foam Parties cannot take place in unsafe weather conditions, including thunderstorms, lightning, heavy rain, or strong wind.
Stopping Use: If weather conditions make the activity unsafe, or if instructed by Norivan, the Client must immediately stop the activity and ensure participants leave the foam area.
Power or Water Failure: If power or water supply fails during the activity, Norivan may pause or stop the session for safety or technical reasons.
Right to Refuse Setup: Norivan reserves the right to refuse setup, stop use, or cancel the service if weather, water, power, surface, or site conditions are unsafe.
8. Damage & Liability
Equipment Damage: The Client is responsible for any damage to Norivan equipment caused by guests, children, adults, venue staff, pets, or third parties during the event.
Covered Equipment: This includes the foam machine, hoses, cables, extension leads, sound system, speakers, bubble or foam equipment, and any other equipment provided by Norivan.
Venue or Property Damage: Norivan is not responsible for damage to grass, plants, pools, pool systems, drainage systems, furniture, flooring, stone surfaces, terraces, clothing, personal belongings, underground utilities, or venue property unless caused directly by proven negligence by Norivan.
Norivan Responsibility: Norivan will take reasonable care to provide a safe and professionally managed Foam Party experience.
Client Responsibility: Norivan is not liable for injuries, accidents, allergic reactions, property damage, losses, or distress caused by failure to follow safety instructions, lack of adult supervision, unsafe behaviour, slipping, falling, unsuitable surfaces, lack of suitable water or power access, low water pressure, venue plumbing issues, skin, eye or respiratory sensitivity, interference with equipment, weather conditions, alcohol misuse, illegal substances, or actions of the Client, guests, venue staff, pets, or third parties.
Legal Limitation: Nothing in these Terms excludes liability where such exclusion is not permitted by applicable law.
