Norivan Kids Entertainment – Terms & Conditions
These General Terms and Conditions apply to services provided by Norivan Kids Entertainment (“Norivan”).
By confirming a booking with Norivan, the Client acknowledges that they have read, understood, and accepted these General Terms and Conditions.
Some services may also be subject to additional service-specific Terms and Conditions. Where a booking includes a specific service such as Bouncy Castles, Mini Disco, Foam Party, Sensory Play, Creative Workshops, or Party Styling, the relevant service-specific Terms and Conditions also apply.
1. Booking & Payment
Deposit: A 30% deposit is required to secure the booking date. The booking is confirmed only once the deposit has been received.
Final Balance: The remaining balance must be paid upon arrival at the venue, before setup begins, unless otherwise agreed in writing.
Non-Payment: Norivan reserves the right to withhold setup or cancel the service if the remaining balance is not paid before installation.
IVA: Prices are shown excluding IVA. 21% IVA will be added to the final invoice.
Payment Methods: Payment can be made by bank transfer, Bizum, or cash where legally permitted.
Official Confirmation: A booking is only considered confirmed once Norivan has received the required deposit and sent an official confirmation message.
Service Availability: All bookings are subject to Norivan’s availability, suitability of the venue, safety conditions, and the requirements of the selected service.
2. Service-Specific Terms
General Application: These General Terms apply to all Norivan bookings.
Additional Terms: Certain services have additional Terms and Conditions due to specific safety, equipment, weather, venue, material, or supervision requirements.
Relevant Service Terms: The Client is responsible for reading the Terms and Conditions relevant to the service booked.
Multiple Services: If a booking includes more than one service, more than one set of service-specific Terms and Conditions may apply.
Conflict Between Terms: If there is any difference between these General Terms and a service-specific Terms and Conditions document, the service-specific Terms will apply to that service.
3. Booking Details, Changes & Timing
Event Information: The Client must provide accurate event details, including date, time, location, type of event, expected number of children, age range, venue type, access information, and any relevant special requirements.
Changes: Any changes to the booking, including time, location, number of children, selected service, setup area, or event plan, must be confirmed in writing.
Personalised, Customised & Pre-Prepared Services: Bookings that include personalised, customised, handmade, sourced, ordered, or pre-prepared elements must be confirmed at least 2 weeks before the event, unless otherwise agreed in writing. This includes, but is not limited to, themed materials, handmade items, decorations, props, activity materials, party surprises, fillings, goodie bags, or any other customised service elements. This allows Norivan enough time to prepare, source, order, personalise, or assemble the required items.
Late Requests: Late requests for personalised, customised, handmade, sourced, ordered, or pre-prepared elements may not always be possible. Norivan will always do its best to help, but availability depends on time, materials, suppliers, delivery times, and workload.
Rush Fee: If a late request can be accommodated but requires urgent sourcing, express delivery, extra preparation time, additional travel, or last-minute changes to the agreed setup, an additional rush fee may apply. Any extra cost will be confirmed with the Client before proceeding.
Extra Guests: Norivan will always do its best to include all children and make sure everyone feels welcome. However, staff, materials, equipment, and activity structure are planned based on the confirmed booking details. If the number of children or guests is significantly higher than agreed, Norivan may need to adapt the activity flow, format, or setup to keep the experience safe and manageable.
Minimum Duration: Some Norivan services and packages have a minimum booking duration. This will be confirmed during the booking process.
Agreed Timing: The service will start and end according to the agreed booking time.
Client Delays: Delays caused by the Client, guests, venue, catering, speeches, late arrivals, access issues, parking issues, or an unprepared setup area do not automatically extend the service time.
Extra Time: Additional time may be possible depending on team availability and may be charged as an extra.
Service Adaptation: Norivan may adapt the activity flow, difficulty, pace, music, games, materials, or format depending on the children’s age, group size, venue conditions, safety needs, and event flow.
4. Access, Parking & Setup Area
Access: The Client must provide clear access to the venue and setup area before Norivan’s arrival.
Parking: The Client must provide suitable parking for the Norivan team. Any parking fees, access fees, loading fees, or venue charges are the responsibility of the Client.
Loading Area: Where equipment, furniture, props, materials, or inflatables are required, the Client must provide a suitable loading area as close as possible to the setup location.
Difficult Access: If the setup requires carrying equipment over long distances, stairs, uneven ground, narrow access points, lifts, gravel, sand, or difficult terrain, this must be disclosed before booking.
Preparation Area: Where required, the Client must provide a private, secure area away from children where Norivan staff can prepare, store belongings, organise equipment, or change if needed.
Setup Area: The Client must provide a safe, clean, dry, and suitable area for the booked service.
5. Public Spaces, Permits & Venue Permissions
Private Venues: Norivan services are designed for private venues such as villas, private gardens, fincas, private homes, or rented event spaces.
Public Areas: Norivan does not usually provide services in public areas, including parks, beaches, plazas, streets, or other open public spaces, due to safety, access, insurance, noise, equipment, and local regulation considerations.
Public Space Requests: A permit from the local Ayuntamiento may only authorise the event itself and does not automatically include permission to bring or set up equipment, furniture, toys, props, materials, decorations, inflatables, sound systems, tables, chairs, sensory bins, or activity setups in that public space.
Client Responsibility: The Client is responsible for ensuring that any permit, venue permission, public space authorisation, or event approval specifically allows the booked service and all required service elements, including music, equipment, activities, water use, foam, inflatables, decorations, furniture, toys, tables, chairs, sensory bins, and any other relevant setup elements.
Service Requirements: Norivan can only provide the service if the permitted setup matches the requirements of the selected service and can be carried out safely and appropriately.
Liability for Fines: Any fines, penalties, event stoppages, legal consequences, or cancellation caused by missing permits, incomplete permissions, venue restrictions, public space restrictions, or lack of official authorisation are the full responsibility of the Client.
No Refund for Missing Permissions: If authorities or venue management stop the event due to missing permissions, incomplete permissions, restricted setup approval, or missing documentation, no refund will be issued.
6. Staff Role, Supervision & Group Size
Role of Norivan Staff: Norivan staff lead, support, and manage the booked entertainment activities. Our role is to create a fun, organised, and professionally managed experience.
Not Childcare Providers: Norivan staff are entertainers, activity leaders, facilitators, or equipment operators depending on the service booked. They are not childcare providers, babysitters, legal guardians, or one-to-one carers.
Adult Presence: Parents, guardians, or responsible adults must remain present and available throughout the event.
Shared Responsibility: The Client remains responsible for the general behaviour, safety, wellbeing, toilet needs, food, drinks, medication, sunscreen, and personal care of the children.
Team Size: Norivan will determine the required team size based on the number of children, ages, venue, service type, activity structure, and safety needs.
Professional Decision: Norivan will advise the appropriate team size required to deliver the service safely and professionally.
Group Management: Norivan will plan the activity structure based on the confirmed number of children, age range, venue, and selected service. If the number of children, age range, or event conditions differ significantly from the confirmed booking details, Norivan may adapt the activity flow, format, or setup to keep the experience safe and manageable.
Additional Adults: Parents, guardians, or responsible adults may be required to support with general supervision, especially for very young children, mixed-age groups, or children requiring one-to-one support.
Setup and Pack-Down: During setup and pack-down, Norivan staff must focus on equipment, materials, layout, technical safety, and preparation. Children must be kept away from setup areas until Norivan confirms that the activity is ready to begin.
7. Health, Allergies & Venue Safety
Medical Information: The Client must inform Norivan before the event of any relevant medical conditions, allergies, sensory sensitivities, dietary restrictions, behavioural needs, mobility needs, or health concerns.
Medication: Norivan staff do not administer medication.
Allergies: Parents, guardians, or responsible adults remain responsible for managing allergies, medication, food, drinks, and any health-related needs.
Illness: Children who are unwell, have fever, vomiting, contagious illness, open wounds, or infectious skin conditions should not participate in shared activities.
Personal Care: Parents or guardians are responsible for sunscreen, hats, suitable clothing, water, snacks, hydration, toilet needs, and personal comfort unless otherwise agreed in writing.
Venue Hazards: The Client is responsible for identifying and managing venue hazards such as pools, stairs, balconies, roads, open gates, animals, sharp objects, fragile items, slippery surfaces, or unsafe areas.
Pool and Water Safety: If an event takes place near a swimming pool, pond, water feature, or open water, the Client must ensure active adult supervision at all times. Norivan entertainers do not provide lifeguard or water-based supervision unless specifically agreed in writing and legally appropriate.
8. Weather & Outdoor Events
Outdoor Setup: For outdoor events, the Client must provide a safe and suitable setup area.
Weather Conditions: Heat, wind, rain, storms, wet ground, direct sun, humidity, or unsafe weather may affect the ability to set up or continue an activity.
Indoor Alternative: The Client should provide a suitable indoor or covered backup area where possible.
Unsafe Conditions: Norivan reserves the right to relocate, pause, adapt, refuse setup, stop an activity, or reschedule where possible if weather or venue conditions create a safety risk.
No Suitable Alternative: If no suitable alternative space is available and the service cannot safely go ahead, Norivan will discuss possible rescheduling options where possible, subject to availability.
9. Behaviour, Safety Rules & Right to Stop
Safe Behaviour: The Client is responsible for ensuring that children and guests behave safely and follow instructions.
Unsafe Conduct: Norivan may pause or stop an activity if children’s behaviour, guest conduct, venue conditions, alcohol misuse, illegal substances, aggression, rough play, or safety concerns create a risk.
Damage or Misuse: Children and guests must not damage, remove, misuse, climb on, throw, pull, tamper with, or interfere with Norivan equipment, materials, props, tools, decorations, cables, speakers, inflatables, furniture, or activity items.
Right to Stop Service: Norivan reserves the right to stop part or all of the service if safety is compromised. No refund will be issued if the service is stopped due to unsafe behaviour, misuse, venue issues, or failure to follow instructions.
10. Equipment, Materials & Property Damage
Equipment Damage: The Client is responsible for any damage to Norivan equipment, materials, props, costumes, furniture, decorations, tools, technical equipment, or activity items caused by guests, children, adults, venue staff, pets, or third parties.
Costs: Repair, replacement, cleaning, or loss-of-use costs may be charged to the Client.
Venue or Property Damage: Norivan is not responsible for damage to furniture, flooring, walls, upholstery, rugs, curtains, clothing, personal belongings, gardens, terraces, pools, or venue property unless caused directly by proven negligence by Norivan.
Suitability of Venue: The Client is responsible for checking that the venue and setup area are suitable for the booked service before the event.
Pre-Existing Damage: Norivan is not responsible for pre-existing damage, stains, marks, or wear to venue property.
11. Cancellation & Rescheduling
More Than 5 Days Before the Event: If the Client cancels more than 5 days before the event, the 30% booking deposit will be refunded.
5 Days or Less Before the Event: If the Client cancels 5 days or less before the event, the 30% booking deposit is non-refundable.
Prepared Materials or Custom Work: If a booking includes customised, handmade, sourced, ordered, or pre-prepared materials, the related material and preparation costs may be non-refundable once preparation has started, even if the booking is cancelled more than 5 days before the event.
Alternative Date: Norivan will always try to find an alternative date where possible, subject to availability.
Unsafe Weather or Force Majeure: If unsafe weather, force majeure, government restrictions, natural disasters, venue restrictions, or circumstances beyond the control of either party prevent the event from going ahead, Norivan may offer to reschedule the booking or provide credit for a future date, subject to availability.
12. Liability, Privacy & Governing Law
Norivan Responsibility: Norivan will take reasonable care to provide a safe, organised, and professionally managed entertainment experience.
Client Responsibility: Norivan is not liable for injuries, accidents, allergic reactions, property damage, losses, or distress caused by:
failure to follow safety instructions;
lack of adult supervision;
unsafe behaviour by children or guests;
misuse of equipment, materials, props, tools, or activity items;
unsuitable venue conditions;
pools, water areas, stairs, balconies, roads, open gates, animals, or venue hazards;
wet, slippery, uneven, hot, dirty, or unsafe surfaces;
undisclosed medical conditions, allergies, or sensitivities;
illness, infection, or hygiene-related issues not caused by Norivan;
weather conditions affecting outdoor events;
alcohol misuse, illegal substances, aggression, or unsafe guest conduct;
actions of the Client, guests, venue staff, pets, or third parties.
Legal Limitation: Nothing in these Terms excludes liability where such exclusion is not permitted by applicable law.
Data Collection: Norivan collects only the personal data necessary to manage the booking, such as name, contact details, event address, event date, and booking information.
Data Protection: Personal data is handled in accordance with applicable data protection laws and Norivan’s Privacy Policy.
Photos & Videos: Norivan will only use photos or videos of children for marketing purposes with prior permission from the parent or legal guardian.
Acceptance: Payment of the deposit and confirmation of the booking means that the Client accepts these General Terms and Conditions, as well as any relevant service-specific Terms and Conditions.
Applicable Law: These Terms and Conditions are governed by the laws of Spain.
Disputes: Any disputes shall be settled in the competent courts of Palma, where legally applicable.
